1. Acceptance of These Terms
Welcome to the games, applications, websites, and related services provided by Atomic Sky Games ("Atomic Sky Games," "we," "our," or "us"). These Terms of Service ("Terms") form an agreement between you and Atomic Sky Games.
By downloading, installing, accessing, or using any of our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Services.
2. Eligibility
You may use our Services only if you are legally permitted to do so in your jurisdiction. If you are not old enough to enter into a binding agreement where you live, you may use the Services only with the permission and supervision of a parent or legal guardian.
Parents and guardians are responsible for the use of the Services by minors under their supervision, including any purchases made through an app store or platform account they control.
3. License to Use the Services
Subject to your compliance with these Terms, Atomic Sky Games grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to download, install, and use our games and applications for your own personal, non-commercial entertainment.
The Services are licensed to you, not sold. Except for the limited rights expressly granted in these Terms, Atomic Sky Games and its licensors retain all rights in and to the Services.
4. Virtual Items and In-Game Content
Some games may include virtual coins, credits, power-ups, cosmetic items, unlocks, boosters, or other digital content (collectively, "Virtual Items"). Virtual Items may be earned through gameplay, provided as rewards, or obtained through optional purchases.
- Virtual Items exist only within the applicable game or Service.
- Virtual Items have no cash value and cannot be redeemed for money.
- Virtual Items may not be sold, transferred, or exchanged outside the Service unless we expressly permit it.
- Your access to Virtual Items is a limited license and does not constitute ownership of property.
We may modify, rebalance, replace, limit, or discontinue Virtual Items or game features when reasonably necessary for game operation, balancing, security, technical compatibility, legal compliance, or continued development.
5. Purchases
Some Services may offer optional purchases of digital content, subscriptions, premium features, or Virtual Items. Purchases made through Apple App Store, Google Play, or another distribution platform are processed by that platform and are also subject to its applicable payment terms and refund policies.
Except where required by law or applicable platform policies, purchases are final and non-refundable. Atomic Sky Games does not receive or store your full payment-card or bank-account information for purchases processed by an app store.
6. Advertising and Rewarded Content
Some Services may contain advertising. Certain games may also offer optional rewarded advertisements that provide an in-game benefit after completion of an eligible advertisement.
Advertising availability, frequency, rewards, and eligibility may change. Third-party advertising services may also be governed by their own terms and privacy policies.
7. User Accounts
Certain Services may allow or require an account. If you create an account, you are responsible for maintaining the confidentiality of your credentials and for activity occurring through your account.
You may not sell, transfer, rent, or otherwise provide your account to another person unless the applicable Service expressly permits it. You should promptly notify us if you believe your account has been compromised.
8. Acceptable Use
You agree not to:
- Cheat, exploit bugs, or intentionally circumvent game rules or technical limitations.
- Use unauthorized bots, scripts, automation tools, cheats, mods, or similar software.
- Modify, reverse engineer, decompile, disassemble, or interfere with the Services except where applicable law expressly permits it.
- Attempt to gain unauthorized access to our systems, servers, accounts, or data.
- Disrupt or impair the operation, security, or availability of the Services.
- Use the Services to harass, abuse, threaten, impersonate, or harm another person.
- Use the Services for fraud, unlawful activity, or infringement of another party's rights.

9. Suspension and Termination

If access to a Service ends, rights granted to you under these Terms for that Service also end. Access to Virtual Items associated with the discontinued or terminated Service may also cease, subject to applicable law and platform rules.
10. Intellectual Property
Our games, software, artwork, graphics, logos, characters, animations, audio, music, text, designs, trademarks, and other content are owned by Atomic Sky Games or its licensors and are protected by copyright, trademark, and other applicable intellectual-property laws.
You may not copy, reproduce, distribute, publicly display, sell, license, commercially exploit, or create derivative works from our content except as expressly permitted by us or applicable law.
11. Updates, Changes, and Availability
Games and online services evolve over time. We may add, remove, rebalance, update, replace, suspend, or discontinue features, content, compatibility, online functionality, or an entire Service.
We may also release updates that are required for continued use. Older versions of an application may no longer function or may lose access to online features.
12. Third-Party Services
Our Services may interact with third parties such as Apple App Store, Google Play, analytics providers, advertising networks, crash-reporting services, hosting providers, social features, or other external services.
Those third parties are independent from Atomic Sky Games and may impose their own terms, policies, and technical requirements. We are not responsible for third-party services that we do not control.
13. App Store and Platform Terms
If you obtain one of our applications through an app store or other distribution platform, your use of that application is also subject to the applicable platform's terms and policies. If these Terms conflict with mandatory platform requirements applicable to the distribution of the application, those platform requirements will control to the extent of the conflict.
14. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AVAILABILITY, OR ERROR-FREE OPERATION.
We do not guarantee that the Services will always be available, uninterrupted, secure, compatible with every device, or free from defects or data loss.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ATOMIC SKY GAMES AND ITS OWNERS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICES.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
16. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Atomic Sky Games and its owners, affiliates, licensors, employees, contractors, and service providers from claims, liabilities, losses, damages, and reasonable expenses arising from your violation of these Terms, misuse of the Services, or infringement of another party's rights.

18. Changes to These Terms
